Terms of Service
Last updated: September 23, 2026
1. Agreement to Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "User") and Next Renewal LLC, a Washington limited liability company operating the Presly platform ("Presly," "Company," "we," "our," or "us"). By creating an account or accessing the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.
We may update these Terms from time to time. The current version is always posted at this URL with its effective date. For material changes, we will provide notice through the Service or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
2. Company Information
Presly is a product of Next Renewal LLC.
Next Renewal LLC 2442 NW Market St, Unit #887 Seattle, WA 98107 Email: support@presly.ai Phone: 253-987-8079
3. Description of Service
Presly is a social media content and scheduling platform for businesses. The Service includes: AI-assisted generation of captions, images, topics, and hashtags; scheduling and automated publishing to the social media accounts you connect (such as Facebook, Instagram, X, LinkedIn, Google Business Profile, TikTok, YouTube, Pinterest, Threads, and Bluesky); publishing of photos and videos you upload; a unified inbox that collects comments, messages, and reviews from your connected accounts, with AI-drafted reply suggestions; analytics; approval workflows; team collaboration; and, on eligible plans, management of multiple client workspaces.
Presly generates and publishes drafts of content at your direction. Presly does not create video content with AI; videos published through the Service are videos you upload.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time. We will make reasonable efforts to notify users of significant changes, but we are not obligated to provide advance notice for all modifications.
4. Eligibility and Account Registration
You must be at least 18 years of age and have full legal capacity to enter into binding agreements to use the Service. The Service is offered to businesses and professionals, not to consumers for personal use.
You may register using a supported sign-in provider (such as Google, Microsoft, or Apple) or with an email address and password. If you register with an email address, you must verify it, choose a strong password, and keep it confidential. You are responsible for safeguarding your account credentials and for all activity that occurs under your account, including activity by team members you invite. Notify us promptly at support@presly.ai if you become aware of any unauthorized use.
Authority to connect accounts. You represent and warrant that you are authorized to connect each social media account you connect to the Service and to publish content to it. If you connect an account belonging to a client or another business (for example, on an agency plan), you represent that you have that business's authorization to do so.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in compliance with these Terms. You may not use the Service to:
- Post or publish content that is unlawful, defamatory, obscene, threatening, or otherwise objectionable
- Create or publish fake reviews, fake testimonials, or fake endorsements of any kind, or present AI-generated text as a statement by a real customer or third party
- Create or publish content depicting identifiable real people without their consent, or content that impersonates any person or business
- Publish AI-generated or AI-modified imagery presented as an actual photograph of your work, premises, staff, or a customer outcome, where doing so is misleading
- Infringe on the intellectual property or other rights of any third party
- Distribute spam or engage in unsolicited mass communications
- Reverse-engineer, decompile, or derive source code from the Service
- Use automated tools to access or scrape the Service without written authorization
- Circumvent or interfere with security features, access controls, or usage limits, including by creating multiple accounts to obtain additional free trials
- Transmit malware, viruses, or other malicious code
- Violate the terms of service, content policies, or automation policies of any connected third-party platform
We reserve the right to investigate suspected violations and to remove content, suspend features, or terminate access at our sole discretion.
6. Subscription Plans and Billing
Presly offers subscription plans billed monthly or annually in U.S. dollars. Current plans and pricing are listed at presly.ai/pricing. By subscribing, you authorize us (or the applicable app store) to charge your payment method on a recurring basis until you cancel.
Web purchases are processed by Stripe. Purchases in the Presly iOS app are processed by Apple through In-App Purchase, and Apple's terms govern those transactions, including auto-renewal, cancellation, and refunds; manage or cancel through your Apple ID settings. Purchases in the Presly Android app are processed by Google Play, and Google's terms govern those transactions; manage or cancel through your Google Play subscription settings.
Except as described in our Refund Policy or required by applicable law, subscription fees are non-refundable, and we do not provide credits or refunds for unused features, partial billing periods, or service interruptions.
Credits. Credits are an in-platform consumable used for AI-powered features. Credits have no monetary value and are non-transferable. Your plan's monthly credit allotment resets at the start of each monthly credit period (on annual plans, each month on your billing anniversary) and does not carry over. Separately purchased credit packs remain available while your subscription is active. All credits are forfeited when your account is terminated or deleted, without refund.
We may update pricing at any time. Price changes take effect at the start of your next billing cycle, and we will provide reasonable advance notice.
7. Free Trial
New accounts receive a 7-day free trial. A valid payment method is required to start the trial. When the trial ends, the payment method on file is automatically charged for the plan you selected, unless you cancel before the trial ends. You can cancel during the trial — on the web in Settings → Billing, on iOS through your Apple ID subscription settings, and on Android through Google Play — and you will not be charged. For subscriptions started through Apple or Google, cancel at least 24 hours before the trial ends (the stores process cancellations on their own schedule), and store rules determine introductory-offer eligibility. Trial credits and features are non-transferable.
One trial per business. We may deny or revoke trials where we detect abuse, including repeated trials through multiple accounts.
8. Cancellation
You may cancel your subscription at any time, on the web in Settings → Billing, or through Apple or Google if you subscribed in a mobile app. Cancellation takes effect at the end of the current billing period, and you retain access until that date. We do not provide prorated refunds for early cancellation. Already-scheduled posts may publish until your access ends. After that, they are saved as drafts for you to review or reschedule.
9. Your Content; License to Presly
You retain all ownership rights you have in content you create, upload, or submit to the Service, including photos, videos, logos, and text ("Your Content"). By submitting Your Content, you grant Next Renewal LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, adapt, create derivative works of (for example, resizing an image or adding a text overlay you configure), transmit, and display Your Content solely as necessary to deliver the Service on your behalf and at your direction.
You represent and warrant that you own or have all rights necessary in Your Content — including any releases required for identifiable people or private property appearing in it — and that Your Content does not infringe any third-party rights or violate applicable law.
AI Output. As between you and Presly, and to the extent permitted by law, Presly assigns to you its rights, if any, in content generated by the Service's AI features for your account ("AI Output"). You acknowledge that under current United States law, purely AI-generated material may not be eligible for copyright protection, that similar output may be generated for other users, and that Presly cannot promise you exclusive rights in AI Output.
10. AI Features and Your Responsibility for Content
The Service uses artificial intelligence — including third-party AI models — to generate captions, images, topics, hashtags, insights, and suggested replies. AI systems make mistakes. AI Output may be inaccurate, incomplete, outdated, misleading, unoriginal, or unsuitable for your business, and it is not legal, medical, financial, or other professional advice.
Everything published through the Service is your publication. You agree that:
- You are the publisher of record. All content published to your connected accounts through the Service is published by you, in your name, under your accounts — whether you wrote it, edited it, approved it, or allowed it to be generated and published automatically under settings you enabled.
- You are responsible for review. You are solely responsible for reviewing, editing, and approving content before it is published where practicable — including reviewing scheduled content before its scheduled time — and in all cases for reviewing content promptly after publication. You can edit or delete any scheduled post before it publishes; once a post is published, you manage or remove it on the social platform itself. Choosing not to review does not shift responsibility to Presly.
- You are responsible for the truth of statements about your business. Every factual claim published through your accounts — about your prices, offers, hours, credentials, licenses, awards, experience, results, or services — is your claim, and you are responsible for its accuracy and substantiation. Presly does not verify facts about your business.
- Testimonials and reviews must be real. You may not publish AI-generated text as a review, testimonial, or endorsement. Any testimonial or review you publish must be genuine, from a real customer, with any material connection disclosed as required by law.
- You are responsible for required disclosures. Where a law or platform policy requires you to label or disclose AI-generated or AI-modified content (for example, platform AI-disclosure tools or synthetic-media rules in your jurisdiction), you are responsible for providing that disclosure.
- Inbox replies are your communications. Any reply, comment, or message sent from your connected accounts through the Service — whether written by you or drafted by AI and sent by you or under settings you enabled — is your communication to your customer.
Presly may apply automated quality checks and content guardrails. These are conveniences, are not guaranteed to catch anything, and do not make Presly responsible for your content.
11. Authorization to Publish on Your Behalf
When you connect a social media account and enable scheduling or automatic publishing, you appoint Presly as your limited agent and authorize Presly to access that account and to create, schedule, publish, and (where you direct) update or delete posts and replies on your behalf, using the settings you configure — including your posting schedule, brand settings, approval settings, and automation settings. This authority is limited to what your settings direct.
You control the settings and can turn automatic publishing off at any time. You can review, edit, reschedule, or delete any scheduled post before it publishes. You may revoke this authority at any time by disabling automatic publishing, disconnecting the account, or closing your account; revocation is prospective only and does not affect content already published.
Presly may, but is not required to, review, screen, delay, or decline to publish any content.
12. Compliance With Laws Is Your Responsibility
Laws governing advertising, marketing, promotions, claims, endorsements, reviews, testimonials, pricing, and professional conduct differ from country to country, from state to state, and from city to city — and they differ again by industry and profession. They change frequently. What is permitted for one business in one place may be prohibited for another business, or for the same business in a different place.
Presly is not a compliance product. The Service does not determine, assess, monitor, or help you comply with any law, regulation, ordinance, licensing requirement, professional rule, or industry code that applies to you. Presly does not know which laws apply to you and makes no representation that any content generated, suggested, scheduled, or published through the Service complies with any law anywhere.
You are solely responsible for determining which laws, regulations, and professional or industry rules apply to your business and every place where you operate or where your content may be received, and for ensuring that everything you publish through the Service complies with them. This includes, without limitation: advertising and consumer-protection law (including the FTC Act and the FTC's rules and guides on endorsements, testimonials, and consumer reviews); rules on comparative claims, pricing, discounts, guarantees, and promotions; health, medical, dental, and wellness advertising rules and licensing-board requirements; legal, financial, insurance, and real estate advertising rules, including fair-housing advertising law; regulated-product advertising rules (alcohol, cannabis, tobacco, firearms, and similar); privacy and data-protection law; and the advertising and content rules of any jurisdiction outside the United States where your content is directed or received.
If your regulator or professional body requires pre-publication review or approval of your communications, you must keep approval-based publishing enabled and must not use fully automatic publishing.
To the maximum extent permitted by law, Presly disclaims all responsibility and liability for whether your use of the Service, or any content published through it, complies with the laws, regulations, or professional rules of any jurisdiction or industry. Presly's role is to generate drafts and to publish content at your direction. The decision to publish, and responsibility for what is published, are yours.
13. Third-Party Platforms
The Service connects with third-party social media platforms. Your relationship with each platform is between you and that platform, and your use of each integration is independently subject to that platform's terms, community standards, advertising policies, and automation rules. You bear the risk of platform enforcement against your accounts, including content removal, reduced distribution, restriction, suspension, or termination.
We are not responsible for changes to third-party APIs, platform policies, rate limits, account restrictions, or service availability, and we do not guarantee that any integration will remain functional or available, that any post will publish successfully or on time, or that platform-reported analytics are accurate.
14. Teams and Agency Workspaces
You may invite team members to your workspaces. You are responsible for the actions of everyone you invite and for keeping their access appropriate. If you manage workspaces for clients, you are responsible for your arrangements with those clients, including authorization to publish to their accounts and the disposition of their content if your account ends. Content in a client workspace remains subject to these Terms, with you responsible to Presly for it.
15. Intellectual Property
The Service and all associated software, interfaces, design, trademarks, and technology are the property of Next Renewal LLC and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights in the Service to you. All rights not expressly granted are reserved.
16. Copyright Complaints (DMCA)
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act. If you believe material available through the Service infringes your copyright, send a notice to:
Copyright Agent, Next Renewal LLC, 2442 NW Market St, Unit #887, Seattle, WA 98107 — support@presly.ai
Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the allegedly infringing material and information reasonably sufficient to locate it; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
We will remove or disable access to material that is the subject of a valid notice and notify the affected user, who may submit a counter-notice. We will terminate, in appropriate circumstances, the accounts of repeat infringers. Misrepresenting that material is infringing may expose you to liability under 17 U.S.C. § 512(f).
17. Privacy
Your use of the Service is subject to our Privacy Policy, which describes what we collect and how we use it.
18. Account Suspension, Termination, and Deletion
We reserve the right to suspend or terminate your access to the Service for violations of these Terms, suspected fraud or abuse, non-payment, legal risk, or platform-imposed requirements. Where practical, we will notify you and give you an opportunity to export your content.
You may delete your account at any time from the Settings page. Deletion removes your account and the content of workspaces you alone own from our live systems right away; residual copies clear from encrypted backups within 14 days. Workspaces that other team members belong to are not destroyed by your departure — your access is removed, and if you were the owner, ownership passes to another member so the team's data survives. We retain billing and tax records as required by law, and limited purchase and connection identifiers used to prevent subscription and trial abuse, as described in our account deletion page and Privacy Policy. Deleting your account does not remove posts already published to your social media accounts — those live on the platforms and are managed there. We cancel web (Stripe) subscriptions for workspaces you alone own as part of deletion, and our team is alerted if a cancellation does not go through — email us about any charge after deletion and verified billing errors are refunded. App-store subscriptions must be canceled through Apple or Google. Subscriptions on shared workspaces that survive your departure continue. Unused credits and remaining subscription time are forfeited without refund.
19. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, Next Renewal LLC disclaims all warranties, express, implied, statutory, or otherwise, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT, and any warranties arising from course of dealing or usage of trade.
Without limiting the above: we do not warrant that AI Output is accurate, truthful, complete, original, non-infringing, lawful, or suitable for your business; we do not warrant that the Service will be uninterrupted, timely, secure, or error-free; we do not warrant that any post will publish successfully, remain published, or reach any audience; we do not warrant any level of engagement, followers, leads, revenue, or other business result; and we do not warrant that your connected accounts will remain in good standing on any platform.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
20. Limitation of Liability
Cap. To the maximum extent permitted by law, the total liability of Next Renewal LLC and its affiliates, officers, members, employees, agents, licensors, and suppliers (the "Presly Parties") for all claims arising out of or relating to these Terms or the Service — whether in contract, tort (including negligence), strict liability, statute, or otherwise — will not exceed the greater of (a) the total fees you actually paid for the Service in the twelve (12) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Excluded damages. To the maximum extent permitted by law, the Presly Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost business, lost goodwill, lost or corrupted data, loss of social media accounts or account standing, regulatory fines or penalties, reputational harm, or cost of substitute services — even if advised such damages were possible, and even if a limited remedy fails of its essential purpose.
Basis of the bargain. The fees for the Service reflect this allocation of risk. These limits survive termination of these Terms.
Savings. Some jurisdictions do not allow certain limitations of liability. Nothing in these Terms limits liability that cannot be limited under applicable law; in those jurisdictions, the Presly Parties' liability is limited to the smallest amount permitted.
This section limits the liability of the Presly Parties only. It does not limit your payment obligations or your obligations under Section 21.
21. Indemnification
You will defend, indemnify, and hold harmless the Presly Parties from and against any and all third-party claims, demands, actions, investigations, or proceedings, and all resulting losses, damages, judgments, settlements, fines, penalties, and costs (including reasonable attorneys' fees), arising out of or relating to:
- (a) Your content and publications — any content you create, upload, edit, approve, schedule, publish, or allow to be published through the Service, including AI Output you published or permitted to be published, and content published automatically under settings you configured; including claims of defamation, false or misleading advertising, unfair competition, right of publicity or privacy violations, and infringement of any intellectual property right;
- (b) Platform terms — your violation of any connected platform's terms or policies, and any platform enforcement against your accounts;
- (c) Laws applicable to you — your violation of any law, regulation, licensing requirement, or professional or industry rule applicable to you, your business, your industry, or the places where you operate or where your content is received;
- (d) Your messages — any reply, comment, or message sent from your connected accounts through the Service;
- (e) Your account and team — any use of the Service under your account, including by team members, and your failure to hold necessary rights in material you upload; and
- (f) Your breach — your breach of these Terms or of any representation in them.
We will notify you of any covered claim and may, at our option and your expense, assume sole control of its defense and settlement. You will not settle any claim in a way that imposes any obligation on a Presly Party without our prior written consent. Your obligations under this section are not subject to Section 20 and survive termination.
22. Governing Law; Dispute Resolution
Governing law and venue. These Terms and any dispute arising from them or the Service are governed by the laws of the State of Washington, without regard to conflict-of-laws rules, and by the Federal Arbitration Act as to arbitration. For any dispute not subject to arbitration, you and Presly consent to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.
Informal resolution first. Before starting an arbitration or lawsuit, you must send us a written notice at support@presly.ai describing the dispute, the account concerned, and the relief you seek (and we must do the same to you). The parties will try in good faith to resolve the dispute for sixty (60) days from delivery of the notice. This step is a condition precedent to filing, and limitation periods are tolled during it.
Arbitration. If the dispute is not resolved, it will be settled by final and binding individual arbitration administered by the American Arbitration Association under its applicable rules, including the AAA's mass-arbitration procedures where applicable. Arbitration will take place in King County, Washington, or by videoconference or on the documents at the claimant's election. The arbitrator decides all issues, except that a court decides the enforceability of the Class Action Waiver.
Class action waiver. YOU AND PRESLY EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to a claim, that claim will be severed and heard in court, and the remaining claims proceed in arbitration.
Carve-outs. Either party may bring an individual claim in small claims court, and either party may seek injunctive or equitable relief in court to protect its intellectual property or confidential information.
Coordinated filings. If twenty-five (25) or more similar arbitration demands are filed by or with the assistance of the same counsel or coordinated entity, the demands will be administered in staged batches under the AAA's mass-arbitration procedures, and the 60-day informal-resolution period applies to each demand individually.
Your right to opt out. You may reject this arbitration agreement by emailing support@presly.ai within thirty (30) days after you first accept these Terms, stating your account email and that you opt out of arbitration. Opting out does not affect any other part of these Terms or your account.
One-year limit. Except where prohibited by law, any claim arising out of these Terms or the Service must be brought within one (1) year after it accrues, or it is permanently barred.
23. General Provisions
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Next Renewal LLC regarding the Service. If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary and the remainder will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control. Sections that by their nature should survive termination (including Sections 9–12 and 19–22) survive. Notices to you may be sent to your account email; notices to us go to support@presly.ai.
